Hearing In Dismemberment Case Delayed By Psychiatric Check

Son Accused Of Dad's Murder, Dismemberment

POSTED: 6:39 am MST November 21, 2008

A court hearing for a 20-year-old Montezuma County man charged with killing, decapitating and dismembering his father has been postponed.

Jeremiah Raymond Berry has pleaded not guilty by reason of insanity to second-degree murder in the February death of his father.

He was charged in April with murder of his father after telling Montezuma County Sheriff's Office detectives he shot his father in the back of the head after his father raped him. He also said he decapitated and dismembered the body and fed flesh to coyotes, according to court documents from the case.

Berry was slated for a status hearing in 22nd Judicial District Court this week. However, Keith Mandelski, chief deputy district attorney, says the hearing was postponed because more time was needed for Berry's psychiatric evaluation.

The hearing has been rescheduled for Dec. 16 before District Judge Douglas S. Walker.

Berry is accused of shooting and stabbing his father, 42-year-old Jack Berry.

According to previous court testimony, detectives found body parts, including a skull, hands and feet, thought to be those of Jack Berry, within buckets of concrete.
